Westerly Flower Designs aims to produce high quality floral products and gifts. If you are unhappy with your purchase please notify us and we will attempt to remedy the situation as soon as it is practically possible. Refunds are at purely at our discretion. Because of the perishable nature of our products you are advised to make any complaint within 1 working day of the delivery or collection of your flowers. We always endeavour to reach an agreement for either refund or replacement depending on the nature of the complaint. All bouquets, wedding flowers and funeral flowers are hand delivered.

Please note there is NO cancellation policy in place for Valentine’s Day, Mother’s Day and at Christmas. Once a bespoke order has been placed they cannot be cancelled for any reason.

In the event that your flowers are not received, please contact us within 24 hours of the expected delivery date so that we can investigate as soon as practically possible. Please make sure that the recipient will be at the address for some time after the expected delivery date. If the recipient no longer resides at the address where delivery has failed we will not be able to refund on the basis that the recipient is no longer there though we will be able to re-send the flowers as part of our guarantee (a re-delivery charge will apply). In the case of flower deliveries to funeral directors, the delivery responsibility ends once the funeral director has received the flowers. We will not be held responsible for the onward delivery of flowers from the funeral directors.

In the case of failed deliveries we do not refund orders unless there has been an error in the order process that a duplicate order has been placed. We do not refund orders once the order has been accepted and is within 48 hours (longer for funeral flowers), nor do we refund based on late or failed deliveries but we guarantee, if the address is correct, to re-send any product as soon as practically possible. If we do refund a cancelled order we reserve the right to charge an admin fee to cover card processing costs and/or time spent processing or planning the order (typically 5% of order value).

If a floral delivery is refused by the recipient for any reason Westerly Flower Designs will not be liable to refund or replace the item. Westerly Flower Designs will, however, try to resolve the matter with the person who ordered the flowers. The contract is between Westerly Flower Designs and the customer who ordered the flowers. Westerly Flower Designs will not enter into any discussions regarding this unlikely sequence of events unless written correspondence is received. Westerly Flower Designs does not deliver flowers to PO Box numbers and cannot delivery to incomplete addresses. Westerly Flower Designs cannot be held liable for incorrect recipient addresses. Please make sure postcodes are complete and correct.

Whilst every effort is made to make deliveries when requested and prevent delivery requests for such dates as public holidays, Westerly Flower Designs cannot be held responsible for delayed deliveries due to factors such as public holidays and factors beyond our control and will endeavour to deliver either before or after dates requested or as soon as practically possible. In the event of the recipient not being at the address at the time of delivery, the driver will endeavour to find a close neighbour to accept the flowers and leave a card informing the intended recipient as to the location. On occasion the flowers will be left in a secure area of the address.

As fresh flowers are a living product there are occasions that a particular flower may be unavailable. Whilst every effort is made to secure the product sometimes it is impossible to use a particular flower. All floral gifts are subject to availability and stringent quality checks. Westerly Flower Designs or any third party delivery agent reserves the right to send a similar floral gift or product of equal or greater value as and when is necessary. Flower stems can be re-cut every two to three days and placed in fresh clean water in a clean vase or container. Perishability will depend on the level of care and lower room temperature.

Payment can be made via the BACS system or payments via Paypal will be subject to payment services and authorisation by the card issuer with information collected via the respective secure online payment systems. If the issuer of your debit card does not authorise payment to us, we will not be liable for any delay or non-delivery.

The copyright for floral images on Westerly Flower Designs website (“images”) are owned exclusively by Westerly Flower Designs. Except as expressly provided below, no image may be used, copies or reproduced in any way (including, without limit, storing in any medium or form (including, without limit, electronically by digital or analogue means or otherwise) without prior written permission by Westerly Flower Designs, except in accordance with the Copyright, Designs and Patents Act 1988.

Notwithstanding the above, you may download and reproduce and transfer to a third party any image for the sole purpose of using such an image together with a news story or newsworthy article in any newspaper, magazine or other news media or publication made available to the general public in hard copy or electronic format and not otherwise (the “Purpose”) provided that the following notice is prominently displayed using suitably obvious text immediately next to, above or below any such copy of reproduction of the image in any such publication. ‘This photograph is reproduced with the permission of Westerly Flower Designs, copyright ©Westerly Flower Designs’.

You may NOT:

1. Use, reproduce or publish any image for any commercial or other reason other than the Purpose;

2. Retain, or allow any third party sent any image by you to retain any image in hard copy for or electronically after completion of the Purpose;

3. Modify, alter, adapt, manipulate, obscure or remove any feature in, combine any other image with or create any montage featuring any image in whole or part by computer or other means;

4. Use any image in any way which in the sole opinion of Westerly Flower Designs will or is likely to be unsuitable or inappropriate or which would or might damage the image or reputation of Westerly Flower Designs jeopardise or threaten to jeopardise or invalidate Westerly Flower Designs copyright.

Your use of any image is subject to you agreeing not to infringe the copyright or other intellectual property rights of Westerly Flower Designs and to inform Westerly Flower Designs in writing of any infringement of any of Westerly Flower Designs copyright or other intellectual property rights in any image as soon as possible on becoming aware of the same.

Warning: An infringement of Westerly Flower Designs copyright or otherwise intellectual property rights may result in a claim under the civil law or criminal prosecution.
